Beechworth Properties Ltd. (“BPL”), Vikram Kalsi (“V. Kalsi”), and Karmjit Kalsi (“K. Kalsi”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, May 31, 2017, and February 26, 2018, regarding a new home in Victoria, B.C. (the “New Home”). On February 26, 2018, BCH issued Compliance Order 18-0015 to BPL, V. Kalsi and K. Kalsi (V. Kalsi and K. Kalsi together, “the Kalsis”) directing that BPL and the Kalsis:
- immediately cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Home; and
- prior to resuming construction on the New Home, provide BCH Compliance Department with proof that the New Home is being built by a Licensed Residential Builder pursuant to section 14(1).
BPL and the Kalsis were directed to comply with Compliance Order 18-0015 by March 23, 2018.
