On, or around, August 30, 2011, Douglas Arthur Nash (“Nash”) sold a new home in Qualicum Beach, B.C. (the “New Home”), that was not enrolled in a policy of home warranty insurance by a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) nor had an Owner Builder Authorization (“OBA”) and corresponding Owner Builder Disclosure Notice (“OBDN”) been issued for the New Home. On April 10, 2012, the HPO issued Compliance Order 12-0023 to Nash ordering that Nash enrol the New Home in a policy of home warranty insurance pursuant to section 22(1) of the Homeowner Protection Act (the “ Act”) or apply, qualify for, and be issued, an OBA for the New Home pursuant to section 20(1) of the Act and section 4.1(2) of the Homeowner Protection Act Regulations (the “Regulations”) and fulfil the requirements of being an owner builder, including obtaining an OBDN. Nash was ordered to comply with Compliance Order 12-0023 by June 1, 2012.
