On June 25, 2024, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Exact Management Ltd. (“EML”) and Mandeep Sandhu (“Sandhu”) were issued a monetary penalty, jointly and severally, in a daily amount of $180, to a maximum of $5,400, for each day that passes until the demands contained in Compliance Order 24-0002 (the “CO”) have been satisfied. This Monetary Penalty was issued for the following reasons:
- EML and Sandhu contravened section 14(1) of the Act regarding a new home in Burnaby, BC (the “New Home”);
- The contravention of the Act by EML and Sandhu was the subject of the CO issued by BC Housing (“BCH”) on January 23, 2024;
- The CO directed EML and Sandhu to cease all construction activities on the New Home and immediately become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act; and
- EML and Sandhu failed to comply with the orders contained in the CO by the requested compliance date.
