Frank Nielsen (FN) Construction Inc. (“FNCI”), Vesti Hakon Henry Nielsen (“V. Nielsen”) and Sean Alexander Frank (“S. Frank”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Lumby, BC (the “New Home”), between the period of, or about, August 4, 2016, and August 2, 2017, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On November 1, 2017, FNCI was approved as LRB 43641. On May 29, 2018, BCH issued Compliance Order 18-0034 to FNCI, V. Nielsen and S. Frank directing that FNCI, V. Nielsen and S. Frank:
- Register the New Home for coverage with a policy of HWI pursuant to section 22(1) of the Act.
FNCI, V. Nielsen and S. Frank were ordered to comply with Compliance Order 18-0034 by June 22, 2018. Complied.
