Gurnam Samra (“Samra”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built, a new home in Surrey, B.C. (the “New Home”), during the period of, or about, 2009 and 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being enrolled with a policy of home warranty insurance. On January 11, 2012, Samra applied for, and was issued a conditional HPO LRB licence. The HPO LRB licence was issued conditionally on the enrolment of the New Home in a policy of home warranty insurance. On October 11, 2012, Compliance Order 12-0048 was issued by the HPO to Samra directing that Samra:
- enrol the New Home with home warranty insurance pursuant to section 22(1) of the Act.
Samra was directed to comply with Compliance Order 12-0048 by November 9, 2012.
