Highline Design Ltd. (“HDL”) and Gary James Osborne (“Osborne”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Victoria, BC (the “New Home”), during the period of, or about, September 2020 and June 2021, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On May 11, 2022, BC Housing (“BCH”) issued Compliance Order 22-0008 to HDL and Osborne directing that HDL and Osborne:
- register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act.
HDL and Osborne were ordered to comply with Compliance Order 22-0008 by June 10, 2022.
