Matthew Lopez (“Lopez”) and Matthew Lopez Contracting Ltd. (“MLCL”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that Lopez and MLCL are BC Housing (“BCH”) Licensed Residential Builder (“LRB”), and contrary to section 14(1) of the Act, conducted the business of a residential builder without being a BCH LRB between the period of, or about, September 25, 2019 and July 22, 2020, regarding a new home in North Saanich, BC (the “New Home”). On July 22, 2020, BCH issued Compliance Order 20-0019 to Lopez and MLCL directing that Lopez and MLCL:
- cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Home;
- immediately cease all signage, marketing and other publications that imply, suggest or hold out in any manner that either Lopez or MLCL is a LRB; and
- prior to conducting the business of a residential builder, Lopez and MLCL must apply for and become a BCH LRB pursuant to section 14(1) of the Act.
Lopez and MLCL were directed to comply with Compliance Order 20-0018 by August 28, 2020.
