Matthew Thomas Renfrow (“Renfrow”) and 0914603 B.C. Ltd. (“0914603”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid Homeowner Protection Office (“HPO”) Residential Builder Licence between the period of December 2, 2013, and August 5, 2014, regarding six new home developments in Langford, BC (the “Properties”), and contrary to section 22 (1) of the Act, completed substantially all of the construction on three new homes at the Properties (the “New Homes”) without each of the New Homes being registered for coverage by home warranty insurance provided by a warranty provider. On August 5, 2014, the HPO issued Compliance Order 14-0043 to Renfrow and 0914603, directing that Renfrow and 0914603:
- cease carrying on the business of a residential builder as defined in the Act; and
- immediately become an HPO Licensed Residential Builder pursuant to section 14 of the Act and register each of the New Homes for coverage by home warranty insurance provided by a warranty provider and ensure that a policy of home warranty insurance is issued for each of the New Homes pursuant to section 22(1) of the Act.
Renfrow and 0914603 were directed to comply with Compliance Order 14-0043 by August 22, 2014.
