Michael Stephen Hanson (“Hanson”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Cluculz Lake, BC (the “New Home”), between the period of, or about, April 24, 2018, and July 19, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (LRB) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. Although BCH received an application for an Owner Builder Authorization (“OBA”) for the New Home (the “Hanson OBA Application”) on March 29, 2019, Hanson failed to take the necessary steps to complete the Hanson OBA Application. On July 19, 2019, BCH issued Compliance Order 19-0009 to Hanson directing that Hanson:
- Immediately complete the Hanson OBA Application, if Hanson meets the eligibility requirements, and be issued an OBA for the New Home; or
- Apply for and become a BCH LRB pursuant to section 14(1) of the Act, and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- Provide BCH Compliance Department proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act.
Hanson was directed to comply with Compliance Order 19-0009 by August 16, 2019.
