O.K. Ceramic Tiles Ltd. (“OCTL”) and Om Kumar Joon (“O. Joon”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Vancouver, BC (the “New Home”), during the period of, or about, December 2, 2014, and July 8, 2016, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. Although OCTL and O. Joon were approved as BCH LRB 42191 on October 13, 2016, the New Home is not covered by a policy of HWI. On September 5, 2018, BCH issued Compliance Order 18-0069 to OCTL and O. Joon directing that OCTL and O. Joon:
- register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act
OCTL and O. Joon were ordered to comply with Compliance Order 18-0069 by October 19, 2018. Complied.
