Olympic Mountain Construction Ltd. (“OMCL”), Jamie McDonald(“McDonald”), and Andre Mark Raknes (“A. Raknes”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), constructed a new home in Sooke, B.C. (the “New Home”), between the dates of November 27, 2012, and February 27, 2013, without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. OMCL was an approved Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) between the dates of November 14, 2011, and November 30, 2012; and OMCL’s HPO licence was closed on February 4, 2013. On June 4, 2014, the HPO issued Compliance Order 14-0038 to OMCL, McDonald, and A. Raknes directing that OMCL, McDonald, and A. Raknes:
- immediately apply for and become an HPO LRB pursuant to section 14(1) of the Act, and immediately enrol the New Home with home warranty insurance pursuant section 22(1) of the Act.
OMCL, McDonald, and A. Raknes were directed to comply with Compliance Order 14-0038 by July 11, 2014.
