Pacific Gate Development Group Ltd. (“PGDG”) and Tom Trung Thanh Nguyen (“Nguyen”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, October 31, 2019, and February 12, 2020, regarding four new homes in Vancouver, BC (the “New Homes”). On February 12, 2020, BCH issued Compliance Order 20-0009 to PGDG and Nguyen directing that PGDG and Nguyen:
- cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Homes; and
- immediately apply for and become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act.
PGDG and Nguyen were directed to comply with Compliance Order 20-0009 by March 27, 2020.
