Palmer Yachts Ltd. (“PYL”) and Paul Clifford Palmer (“Palmer”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid Residential Builder Licence between the dates of, or about, April 22, 2015, and April 22, 2015, regarding 3 new and never occupied homes in Richmond, B.C. (the “New Homes”). On August 28, 2015, a BC Housing Compliance Investigator issued Compliance Order 15-0031 to PYL and Palmer, directing that PYL and Palmer:
- cease carrying on the business of a residential builder as defined in the Act;
- immediately apply for and become a Licensed Residential Builder pursuant to section 14(1) of the Act; and
- cease the above noted activities until such time as PYL is issued a Residential Builder Licence pursuant to section 14 of the Act.
PYL and Palmer were directed to comply with Compliance Order 15-0031 by September 18, 2015.
