Pasha Construction Ltd. dba PASCON Building Group (“PCL”), Nasser Afrough (“N. Afrough”) and Hossein Afrough (“H. Afrough”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that PCL, N. Afrough and/or H. Afrough is a licensed residential builder during the periods of May 31, 2020, and December 1, 2021, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”). On December 1, 2021, BCH issued Compliance Order 21-0023 to PCL, N. Afrough and H. Afrough, directing that PCL, N. Afrough and H. Afrough:
- immediately, cease all signage, marketing, advertising, and other publications that imply, suggest, or hold out in any manner that either PCL, N. Afrough or H. Afrough is a licensed residential builder; or
- immediately become a BCH LRB pursuant to section 14 of the Act.
PCL, N. Afrough and H. Afrough were ordered to comply with Compliance Order 21-0023 by January 14, 2022.
