On November 13, 2019, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Ryan Lee Davies (“Davies”) dba R Davies Developments (“RDD”) was issued a monetary penalty in a single amount of $9,450. This Monetary Penalty was issued for the following reasons:
- Davies dba RDD, contrary to s. 14(1) and s. 22(1) of the Act, constructed a new home in Blind Bay, BC (the “New Home”), between November 2, 2016, and October 20, 2017, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider;
- The contraventions of the Act by Davies dba RDD are the subject of Compliance Order 18-0012 (the “CO”) issued by BCH on March 7, 2018. The date for complying with the CO was March 30, 2018;
- the CO directed Davies dba RDD, amongst other things, immediately apply for and become a BCH LRB pursuant to s. 14(1) of the Act, and register the New Home for coverage by HWI provided by a warranty provider pursuant to s. 22(1) of the Act; and
- Davies dba RDD failed to comply with the order contained in the CO by the requested compliance date.
