S A S Johal Enterprises Inc. (“SAS”) and Avtar Singh Johal (“Johal”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a Homeowner Protection Office ("HPO") Licensed Residential Builder ("LRB") between the dates of May 2, 2014, and October 16, 2014, regarding a new home in Burnaby, BC (the “New Home”). On October 27, 2014, the HPO issued Compliance Order 14-0060 to SAS and Johal directing that SAS and Johal:
- immediately, cease carrying on the business of a residential builder as defined in the Act. More specifically, cease engaging in, arranging for or managing the construction of any new home, including such activities as continuing construction of a new home, or contracting, or otherwise agreeing, to build a new home for an owner or developer. Cease carrying on the business of a residential builder for any new home for which a building permit has already been obtained, for which construction has commenced but has not yet been completed and/or the new home sold, or for any new home for which a Purchase/Sale Agreement has been entered into, but not yet completed, and specifically includes, but not limited to, the New Home; and
- become an HPO LRB pursuant to section 14 of the Act should SAS and Johal wish to carry on the business of a residential builder.
SAS and Johal were directed to comply with Compliance Order 14-0060 by November 14, 2014.
