On February 14, 2017, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Stregger Construction Inc. (“SCI”), Jeremy Christopher William Stregger (“J. Stregger”), and Mary Nadine Stregger (“M. Stregger”), jointly and severally, were issued a monetary penalty in a daily amount of $202, to a maximum of $6,050, for each day that passes until the demands contained in Compliance Order 16-0002 have been satisfied. This Monetary Penalty was issued for the following reasons:
- SCI, J. Stregger, and M. Stregger, contrary to s. 14(1) of the Act, conducted the business of a residential builder without a valid Residential Builder Licence between the dates of, or about, May 13, 2013, and May 13, 2014, and contrary to s. 22(1) of the Act, constructed or caused to have constructed a new home in Fort St. John, BC (the “New Home”), during the period of, or about, May 13, 2013, and November 24, 2014;
- The contraventions of the Act by SCI, J. Stregger, and M. Stregger are the subject of Compliance Order 16-0002 (the “CO”) issued by a Compliance Investigator on January 21, 2016. The date for complying with the CO was February 26, 2016;
- The CO directed SCI, J. Stregger, and M. Stregger to immediately apply for and become a Licensed Residential Builder pursuant to s. 14(1) of the Act and immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to s. 22(1) of the Act; and
- SCI, J. Stregger, and M. Stregger failed to comply with the orders contained in the CO by the requested compliance date.
