Tongue and Groove Construction Ltd. (“TGC”), Justin Terry Unrau (“Unrau”)and Nathan Edward Mattern (“Mattern”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), constructed a new home in Terrace, B.C. (the “New Home”), between the period of, or about, August 24, 2017, and March 2, 2018, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On March 7, 2018, BCH issued Compliance Order 18-0016 to TGC, Unrau and Mattern directing that TGC, Unrau and Mattern:
- immediately cease carrying on the business of a residential builder as defined in the Act and cease continuing construction on the New Home; and
- immediately apply for and become a BCH LRB pursuant to section 14(1) of the Act, and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act.
TGC, Unrau and Mattern were ordered to comply with Compliance Order 18-0016 by April 6, 2018.
