Yin Chee Lee (“Lee”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) between the period of, or about, April 13, 2018, and August 28, 2019, regarding a new home in Vancouver, BC (the “New Home”). Lee, contrary to section 22(1) of the Act, built or caused to have built the New Home between the period of, or about, April 2, 2019, and August 28, 2019, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On August 28, 2019, BCH issued Compliance Order 19-0016 to Lee directing that Lee:
- cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Home; and
- immediately apply for and become a BCH LRB pursuant to section 14(1) of the Act and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act.
Lee was directed to comply with Compliance Order 19-0016 by October 25, 2019
