Compliance Order

Darcy Finch (“Finch”) built a new home in Hixon, BC, (the “New Home”) sometime between April 2008, and May 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance. On May 24, 2012, the HPO issued Compliance Order (“CO”) 12-0021 to Finch directing that he become an HPO LRB pursuant to section 14 of the Homeowner Protection Act (the “Act”) and obtain home warranty insurance for the New Home pursuant to section 22 of the Act.

Darcy (Russell) Franklin (“Franklin”), Brad Philip (“Philip”), and Meranti Developments Ltd. (“MDL”), constructed a new home in Kamloops, B.C. (the “New Home”), between December 12, 2012, and November 22, 2013.

Darlene Helen Lessard (“Lessard”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced construction or caused to have commenced construction of a new home on Denman Island, BC (the “New Home”), during the period of, or about, July 31, 2019, and August 6, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Darrel David Jones (“D. Jones”) and Catherine Hazel Jones (“C. Jones”) (together ,“ the Joneses”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Blind Bay, B.C.

David Alexander Borden (“D. Borden”) and Lynn Kelly Borden (“L. Borden”) (together, the “Bordens”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Falkland, BC (the “New Home”), during the period of, or about, 2007 and 2011, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

David Anthony Harper (“D. Harper”) and Margaret Yvonne Harper (“M. Harper) (together,  “the Harpers”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), constructed a new home in or near Chase, B.C. (the “New Home”), sometime prior to September 23, 2015, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

David Anthony Sims Quinn (“Quinn”) and Kelly Jean Colleen Comishin(“Comishin”), contrary to sections 20.1(1)(b) and 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Ta Ta Creek, B.C.

Davied Broderick (“Broderick”), Daniel Howden (“Howden”), and Beach Grove Properties Ltd. (“BGPL”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid Homeowner Protection Office (“HPO”) Residential Builder Licence between the period of, or about, June 12, 2012, and April 26, 2013, regarding a new home development in Tappen, B.C.

Dean Kenneth Heyland (“Heyland”), contrary to section 14(1) and section 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Denman Island, B.C., (the “New Home”), during the period of, or about, 2009 and 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”), and without the New Home being covered by a policy of home warranty insurance. On January 18, 2013, the HPO issued Compliance Order 13-0002 to Heyland directing that Heyland:

Deborah Louise Williams (“D. L. Williams”) and David Norman Williams (“D. N. Williams”) (together, “the Williamses”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Endako, BC (the “New Home”), sometime prior to September 24, 2020, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) p

Dema Developments Ltd. (“DDL”), Sunny Singh Deol (“Deol”), Sukhvinder Kaur Mandair (“S.K. Mandair”), and Sachan Mandair (“S. Mandair”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), constructed, or caused to have constructed, two new homes in Mission, BC (collectively, the “New Homes”), without each of the New Homes being registered for coverage by home warranty insurance provided by a warranty provider.

Derek John Wolstenholme (“D.J. Wolstenholme”) and Deborah Elisabeth Hamilton Wolstenholme (“D.E. Wolstenholme”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced construction and continued construction on a new home in Victoria, B.C. (the “New Home”), during the period of, or about, July 2007, and July 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Derrick Jolly Construction Ltd. (“DJCL”) and Martyn C. Jolly (“M. Jolly”) built or caused to have built a new home in Blind Bay, BC (the “New Home”), sometime prior to October 8, 2016. Although DJCL has been a BC Housing (“BCH”) Licensed Residential Builder (23109) since August 14, 2002, contrary to section 22(1) of the Homeowner Protection Act (the “Act”), the New Home was not registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On January 19, 2018, BCH issued Compliance Order 18-0001 to DJCL and M.

Dharm Joshi (“D. Joshi”) dba VDJ Custom Homes (“VCH”) and Vikash Joshi (“V. Joshi”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, September 30, 2019, and January 8, 2020, regarding a new home in Duncan, BC (the “New Home”). On January 8, 2020, BCH issued Compliance Order 20-0002 to D. Joshi dba VCH and V. Joshi directing that D.

Diane Evelyn Culling (“D. Culling”) and Brad Alan Culling (“B. Culling”) (together, “the Cullings”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Sointula, B.C. (the “New Home”) in, or about, 2014, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Donald Gordon Lea (“Lea”), Clifford Reginald Mcintosh (“C. Mcintosh”) and Verda Berdemia Mcintosh (“V. Mcintosh”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “ Act”), built a new home in Vernon, B.C., (the “New Home”) sometime between April 17, 2008 and March 2, 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Donald Marcel Gaudreault (“D. Gaudreault”) and Rosalina Pineda Gaudreault (“R. Gaudreault”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Twin Bays, BC (the “New Home”), during the period of, or about, January 8, 2016, and March 20, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Donna Simone Marie Revet (“Revet”) and Joseph William Hewitt (“Hewitt”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on two new homes in Cluculz Lake, BC (the “New Homes”), between the period of, or about, March 18, 2016, and August 12, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (LRB) and without each of the New Homes being registered for coverage by home warranty insurance (“HWI”) provided by a warranty pro

Doreen Heather Menu (“D. Menu”), contrary to section 22(1.1) of the Homeowner Protection Act (the “Act”), offered for sale a new home near Vanderhoof, B.C. (the “New Home”), between March 4, 2014, and April 14, 2014, without the New Home being covered with a policy of home warranty insurance pursuant to section 22(1) of the Act. On April 14, 2014, the Homeowner Protection Office (“HPO”) issued Compliance Order 14-0029 (the “CO”) to D. Menu directing that D. Menu:
